The article analyzes the problem of intractable in practice legal relations arising in connection with labor protection in correctional institutions and regulation of the procedure for bringing convicts sentenced to imprisonment to disciplinary responsibility for violations of labor protection requirements. A study was conducted and evaluated by the administration of correctional institutions of documents that record violations by convicts of violations of labor protection requirements and the grounds for taking disciplinary measures for compliance with the current legislation of the Russian Federation (Labor Code of the Russian Federation, the Penal Code of the Russian Federation, local regulations regulations of the employer). Differentiation of the causes and conditions made it possible to propose concrete measures to strengthen the control and prevention of occupational injuries in prisons.
Highlights:
1. On the facts of violation of labor protection requirements by convicts, only 3.4% of the total number of violators are brought to disciplinary responsibility.
2. Responsibility for the above violations is not provided for in the Criminal Executive Code of the Russian Federation and the internal regulations of correctional institutions.
3. The practice of punishment for insufficient measures in the field of labor protection and the prevention of injuries and accidents in the production of correctional institutions is more aimed at the employer.
4. Legal relations on the observance of safe working conditions in correctional institutions should be reciprocal in nature, both for the administration of correctional institutions and for convicts involved in socially useful work.
