The article considers a case of the emergence of private property rights in respect of land plots on which tenement houses are located. We conduct a chronological analysis of operations with land plots in connection with legislation current on that moment and regulatory framework. We revealed the facts of violation of land legislation during division of a land plot with tenement houses located on it, and violations in registering ownership of these plots. The article proposes an option to return land plots to the common ownership of the owners of residential and non-residential premises. We studied the economic risks. The findings will be useful to experts engages in the real estate.
