Abstract:

Primary residential real estate market has such negative social and economic phenomenon as construction in progress and defrauded real estate investors. In this regard, we have set a goal to analyze the practice of violation of the law in equity construction. To identify the main types of violations of the law, the materials of criminal cases related to the violation of the current legislation on housing construction in the Republic of Tatarstan and the Kirov region were studied. According to the results of the study, the main types of violations were identified, fraud schemes were established and the conditions conducive to the commission of crimes were determined. According to the results of the analysis of the law on equity participation and the practice of relations between developers and shareholders, the risk provisions of equity contracts provided for signature to citizens are established. Also, a comparative characteristic between the classical scheme of equity construction and project financing, launched from July 2019, is presented. The results show that in the conditions of decrease of effective demand and carrying out of measures of control over projects it is expedient to keep the existing scheme of share construction, but not to enter the new, indirect, through banks, the scheme of financing of construction. The presented conclusions can be used by the bodies exercising control over the construction of residential facilities.
